§ 1 Basic Provisions

Scope of Application:

(1) The following Terms and Conditions shall apply to all contracts that you conclude with us as the Seller (SellerX Commerce GmbH, Chausseestraße 19, 10115 Berlin, Germany) via the website https://kwmobile.com/pages/b2b-terms-and-conditions unless an amendment is agreed in writing between the parties. Deviating or conflicting terms and conditions shall only be effective with our express written consent.

Eligible Buyers:

(2) We offer our goods for sale only if you are a natural or legal person or a partnership with legal capacity that is acting in the exercise of its commercial or independent/self-employed professional activity (entrepreneur). A conclusion of a sale contract with consumers is excluded.

§ 2 Conclusion of the Contract

Subject Matter:

(1) The subject of the contract is the sale of goods. The details, in particular the essential characteristics of the goods can be found in the item description and the supplementary information provided on our website.

(2) Our offers on the Internet do not constitute a binding offer to conclude a contract.

(3) You can place a binding purchase offer (order) by e-mail, in writing or via the online shopping cart system. When purchasing via the online shopping cart system, the goods intended for purchase are placed in the "shopping cart". You can access the "shopping cart" via the corresponding button in the navigation bar and make changes at any time.

After calling up the "checkout" page and entering the personal data as well as the payment and shipping details, all order data will finally be displayed again on the order overview page. Before sending the order, you have the opportunity to check all the information again, change it (also using the "back" function of the Internet browser) or cancel the purchase.

By clicking the corresponding button to submit the order, you place a binding offer with us. You will first receive an automatic e-mail about the receipt of your order, which does not yet lead to the conclusion of the contract.

(4) The acceptance of the offer (and thus the conclusion of the contract) takes place within two (2) business days by confirmation in text form (e.g. e-mail), in which the execution of the order or delivery of the goods is confirmed to you (order confirmation). If you have not received a corresponding message within this period, you are no longer bound to your order. In this case, any services already rendered will be refunded immediately.

(5) Upon request, we will create an individual offer for you, which will be sent to you in text form and to which we will be bound for five (5) days. You accept the offer by confirming it in text form.

(6) The processing of the order and the transmission of all information required in connection with the conclusion of the contract is carried out by e-mail, in part automatically. You must therefore ensure that the e-mail address you have provided to us is correct, that the receipt of e-mails is technically guaranteed and, in particular, that it is not prevented by SPAM filters.
